GDPR is coming and there’s no avoiding it

The General Data Protection Regulation (GDPR) comes into force in May 2018 and it affects every UK business that collects personal information online.

If your business website collects information through a form then you have to act. If you don’t you could face fines of up to 20 million euros. A requirement for stronger ‘consent’ is at the centre of the new regulations. Consent to collect and store personal data must be explicit before collection takes place. Your Privacy Policy needs to be clear how that data is stored and used. Consumers must be able to request access and view that data and they must be able to request their data be removed.

So if you have any forms on your website that collect personal data such as email marketing opt-in, contact form or CRM then you will need to add a statement on the form saying what the information is being collected for. You will also need an explicit check box opt-in that must be ticked before the form can be sent and a link to your full Privacy Policy statement.
